Notice, maintenance, and the condition of the property

A premises claim may depend on what the owner knew, what inspection should have revealed, and whether the dangerous condition could have been corrected or warned about.

• Preserve photographs, video, incident reports, and witness information.
• Examine inspection practices, maintenance records, prior complaints, and notice.
• Separate transitory-substance claims from negligent-security and other property conditions.

Florida Statute§ 768.0755

For a transitory foreign substance in a business establishment, the claimant must prove actual or constructive knowledge of the dangerous condition.
